US Judge Orders Release of Abrego Garcia from ICE Detention

Courtroom scene

A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in immigration detention.

In her decision, the judge noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal proceedings center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

Terms of Freedom

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.

This decision represents a notable development in a complex legal battle involving claims of wrongful detention and disputed criminal associations.
