Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and status as a newcomer motivated his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Financial Stakes and a Will to Win
The owner disclosed financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Nascar Cup series team launched with partner Polk and driver Hamlin.
“Someone had to step forward,” Jordan said during testimony. “I was a new person, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for about sixty minutes and exited the courthouse to a media frenzy, with onlookers and reporters vying for a glimpse or a picture of the sports legend.
Spearheading the Fight
23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a business model Jordan contended is breaking the law to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a frantic and emotional six hours where the racing circuit told teams they had to sign a contract extension. This agreement consists of over a hundred pages detailing pay for chartered teams and a guaranteed entry in Nascar-sponsored races.
Choosing Litigation
Jordan explained that his team and its ally concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar refused to engage, according to his testimony.
The Bottom Line: Victory
Ultimately, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Winning.
“Denny convinced me adding a third car boosted our odds of winning,” he testified, noting that he purchased another franchise last year for $28 million despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the timing of the signature deadline was problematic.
She said, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, that’s the number.”
